Nike wins the legal cause against Stockx for the sale of false sneakers
The legal cause of Nike against Stockx began in 2022, when Nike discovered that the platform sold its counterfeit sneakers. Nike conducted an investigation into Stockx and found several counterfeit sneakers and several buyers who bought Nike False on Stockx.
Nike sued at Stockx and a judge of the District Court of the United States of New York sided in favor of Nike’s statements that Stockx sold counterfeit shoes, revealed for the first time in a legal case in 2023. The Court order confirmed that Stockx is responsible for the sale of 37 pairs of counterfeit sneakers In relation to this case, which includes four pairs sold to Nike investigators and 33 pairs to a third party buyer named Roy Kim.
The court rejected the other claims of Nike in its motion, which accused Stockx of violation of the brand, false denomination of origin, dilution of the brand, damage to the corporate reputation and deceptive advertising. Even the entire motion of Stockx against Nike was rejected.
The suspended claims will be resolved in court, which will be held between June 15, 2025 and November 15, 2025.
In a note Stockx said “We are pleased that the court has denied all Nike’s statements relating to false advertising. The judge also rightly rejected the accusations of Nike’s intention in relation to counterfeiting, a decision that serves as a testimony of the significant investment that Stockx has made in preventing the trade of counterfeit products on our platform. The verification has been fundamental for Stockx since our start: we have invested millions of dollars in technology, training and tools and we support each product sold on Stockx with our promise of the buyer. In this case and on a continuous basis with all our customers, we offer reimbursements or substitutions if someone receives an incorrect product. The products in question in this case amount to a mere 0,0004% of the stocks of 17.8 million Nike sneakers examined while this dispute was in progress. Compare it with the over 80,000,000 dollars of suspicious sneakers only counterfeit that Stockx has prevented being sold on our platform since launch in 2016. It is a pity that instead of working with us to fight the fakes, Nike has instead chosen to use his resources to pursue disputes without merit and expensive.
